Trademark Registration in Vietnam: Requirements and Procedure

Trademark registration requirements in Vietnam:

- Power of attorney simply signed. 
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number, the business line of the applicant).
- Invoicing details (name, address, fiscal number, registration number).
- Certified copy of priority document in case priority is to be claimed.

 Trademark registration procedure in Vietnam:

The registration procedure lasts 12 – 14 months. The trademark will be published in the Official Bulletin of Marks. No opposition can be filed. The protection lasts 10 years from the filing date.

Other trademark procedures in Vietnam:

Trademark renewal in Vietnam: The trademark renewal may be done within the 6 months before expiry with a grace period of 6 months from due date. For the renewal we need the simply signed power of attorney and the original certificate of registration. After renewal protection lasts 10 years.
Trademark change in Vietnam: For changing the name or address we need the power of attorney simply signed, the official document certifying change of name and the certificate of registration.
Trademark assignment in Vietnam: For the assignment we need the power of attorney simply signed, the assignment document notarized and the original certificate of registration. There are no stamp duties. Assignment may be done with or without Goodwill. Pending application may be assigned, unregistered marks may not be assigned. For a natural person assignor a 5% tax in payable. For a legal entity assignor a 15% tax in payable.
Trademark use in Vietnam: Non-use for 5 years following registration makes the registration vulnerable to cancellation.
