Trademark Registration in Spain: Requirements and Procedure
Trademark registration requirements in Spain:
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The details of goods and/or services for witch the trademark will be registered or the classes in case they are known
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Information related to the previously filed trademarks, in order to benefit of the priority date, if it is the case. In case that priority is claimed, the certified copy of the priority document will be filed simultaneously with the application.

Time frame for registration - In general Spanish marks that are not facing objections mature into registration within six months from the filing date.

Trademark assignment in Spain: For the trademark assignment we need the power of attorney signed by the assignee and assignor and the deed of assignment notarized and legalized up to the consulate. For the assignments subjects the taxes must be paid. There is no stamp duty and the assignment can be done with or without Goodwill. Trademark use in Spain: A registered mark may be cancelled if it has not been used for consecutive 5 years from the date of publication of the grant thereof (or the date of the last use).
