In Europe there are 3 systems of trademark registration:
1. European trademark (also known as Community trademark, EU trademark, OHIM trademark - O.H.I.M. system) may be registered by a single trademark registration filing with O.H.I.M. within countries that are members of European Union.
2. National trademark registration, in each European country.
3. International trademark (also known as WIPO trademark), may be registered with W.I.P.O. within European countries that are members of the WIPO system (Madrid Agreement and/or Madrid Protocol - W.I.P.O. system).


Trademark Registration in Spain: Requirements and Procedure

Trademark registration requirements in Spain:

- Power of attorney simply signed. You can download our Power of Attorney here.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The details of goods and/or services for witch the trademark will be registered or the classes in case they are known
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Information related to the previously filed trademarks, in order to benefit of the priority date, if it is the case. In case that priority is claimed, the certified copy of the priority document will be filed simultaneously with the application.

Trademark registration procedure in Spain:

Time frame for registration - In general Spanish marks that are not facing objections mature into registration within six months from the filing date.

Other trademark procedures in Spain:

Trademark renewal in Spain: For the trademark renewal we need the simply signed power of attorney, and the declaration of use signed before the public notary, legalized by Apostil or Spanish Consulate indicating the use of the trademark. After renewal the trademark protection lasts 10 years.
Trademark change in Spain: For the change of name or address we need the simply signed power of attorney.
Trademark assignment in Spain: For the trademark assignment we need the power of attorney signed by the assignee and assignor and the deed of assignment notarized and legalized up to the consulate. For the assignments subjects the taxes must be paid. There is no stamp duty and the assignment can be done with or without Goodwill. Pending applications may be assigned, unregistered marks may be assigned,
Trademark use in Spain: A registered mark may be cancelled if it has not been used for consecutive 5 years from the date of publication of the grant thereof (or the date of the last use).
