Trademark Registration in Saudi Arabia: Requirements and Procedure

Trademark registration requirements in Saudi Arabia:

- Power of attorney, legalized up to the Consulate of Saudi Arabia. One power of attorney can be used for several applications.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The details of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Certified copy of priority document in case priority is to be claimed.

Trademark registration procedure in Saudi Arabia:

The trademark registration procedure lasts 12 months. After the acceptance the trademark will be published in the Official Gazette. The opposition can de filed within 3 months. The trademark protection lasts approximately 10 Hijra years (less 100 days) from the filing date.

Other trademark procedures in Saudi Arabia: 

Trademark change in Saudi Arabia: For the change of name or address we need the power of attorney duly legalized up to the Consulate of Saudi Arabia, the certificate of change of name duly legalized up to the Consulate of Saudi Arabia, a certificate issued by the applicant attesting the change of address duly legalized up to the Consulate of Saudi Arabia and any relevant original registration certificate for endorsement purposes. The registration of change of name requires the publication in the official gazette but the registration of change of the address doesn’t require publication.
Trademark renewal in Saudi Arabia: For the trademark renewal we need the power of attorney notarized and legalized up to the Consulate of Saudi Arabia and the registration certificate for endorsement. The trademark renewal procedure may be done within 12 months before expiry, a grace period of 6 months is allowed for late renewal after the payment of a penalty. After renewal trademark protection lasts 10 Hijra years (less 100 days) from the filing date.
Trademark assignment/merger in Saudi Arabia: For the trademark assignment we need the power of attorney duly legalized up to the Consulate of Saudi Arabia, the deed of assignment legalized and executed by both assignor and assignee and the registration certificate for endorsement.
Trademark license in Saudi Arabia: For the trademark license we need the power of attorney duly legalized up to the Consulate of Saudi Arabia, the license agreement duly legalized up to the Consulate of Saudi Arabia and the registration certificate for endorsement purposes.
Trademark use in Saudi Arabia: Non-use for 5 years following registration makes the registration vulnerable to cancellation; intent-to-use applications may be field in Saudi Arabia.
