1. National trademarks may be registered through the State Trademark Office.
2. International trademarks may be registered through W.I.P.O. system.


Trademark Registration in Oman: Requirements and Procedure

Trademark registration requirements in Oman:

- Power of attorney legalized up to the Consulate of Oman. You can download our Power of Attorney here.
- Certificate of Incorporation or extract from the commercial register legalized up to the Consulate.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Information related to the previously filed trademarks, in order to benefit of the priority date, if it is the case. In case that priority is claimed, the certified copy of the priority document will be filed to the Trademark Office in Oman within three months of filing date.

Trademark registration procedure in Oman: 

After acceptance the trademark is published in the Official Gazette and one daily newspaper. The opposition period is within 3 months following publication. The registration procedure lasts 18 months. The protection lasts 10 years from the filing date.

Trademark registration procedure in Oman:

Trademark renewal in Oman: The trademark renewal may be done within 12 before expiry. For the trademark renewal we need the power of attorney legalized up to the Consulate of Oman. After trademark renewal the protection lasts 10 years.
Trademark changes in Oman: For changing the name or the address we need the power of attorney duly legalized that is showing the new name and/ or address, and a certified copy of the certificate of change of name and/ or address legalized.
Trademark assignment and trademark license in Oman: For the trademark assignment we need the power of attorney legalized up to the Consulate of Oman by the assignee, a legalized deed of assignment executed by both the assignor and the assignee and a certified copy of the certificate of incorporation or extract from the commercial register of the assignee legalized up to the Consulate. For the trademark merger or license we need the power of attorney legalized up to the Consulate of Oman, a legalized certificate of merger or license agreement and a certified copy of the certificate of incorporation or extract from the commercial register of the licensee company legalized. The license agreement should indicate the trademark registration number in Oman.
Marketing agency agreements between an Omani entity and foreign company have to be registered with the Department of Commercial Agencies, Ministry of industries and Commerce. For the marketing agency agreement we need a power of attorney legalized from the licensor and a license agreement legalized and its Arabic translation.
Trademark use in Oman: Non-use for 5 year following registration, a cancellation action may be filed a third party.
