Trademark Registration in Morocco: Requirements and Procedure

Trademark registration requirements in Morocco:

- Power of attorney simply signed and stamped by the applicant; the name and capacity of the signatory should be indicated clearly on the power of attorney. An advanced copy by fax or e-mail will be accepted.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Certified copy of priority document in case priority is to be claimed.

Trademark registration procedure in Morocco:

The trademark registration procedure lasts 2 – 3 months. After the registration the trademark will be published in the Official Gazette. The opposition period is for 2 months from the publication date. As of 18 December 2004 the new IP Law became into force so that one application will cover 2 zones Casablanca and Tangier. The period of protection is 10 years. The protection lasts 10 years from the filing date.

Trademark registration procedure in Morocco:

Trademark renewal in Morocco: The trademark renewal may be done within the 6 months before expiry with a grace period of 6 months. For the renewal we only need the simply signed power of attorney. After renewal, the protection lasts 10 years.
Trademark assignments and license in Morocco: For the assignment we need the power of attorney simply signed and sealed by the assignee, the deed of assignment or license executed by both parties. The duration of agreement must be indicated and should not exceed the validity date of the mark subject of the license or registered user.
Trademark change in Morocco: For changing the name or the address we need the power of attorney simply signed by the licensee, a certified copy of certificate of change of name and/or address.
Trademark use in Morocco: A registered mark may be cancelled if it has not been used for consecutive 5 years.
Registration with Custom Duty Department: For the trademark registration procedure we need the signed power of attorney and the certified copy of trademark registration certificate. It is possible to record and registered trademark in Morocco with the Customs Authorities at any time during the validity period of his trademark in order to suspension of imported counterfeit goods. Such application can be filed can be submitted by the legal representative or the licensee of the trademark. The request for suspension is valid for one year and can be renewed each year. Once imported products are suspected to be counterfeited, the customs inform immediately the right holder or his agent who should within 10 days justify to customs that a preliminary injunction has been ordered by the president of the court or that a court action has been initiated against payment of a guarantee. Otherwise, the suspension measure is forfeited and becomes void. Customs are allowed to provide the trademark owner with available information on the importer of counterfeits and the origin. Once the suspended goods are declared being counterfeit by a final court decision, they would be destroyed.
