Trademark Registration in Mauritius: Requirements and Procedure

Trademark registration requirements in Mauritius:

- Power of attorney legalized up to a Consul Mauritius, if no such Consul is available in a certain country, then legalization has to be done up to a British Consular or attested by an Apostille.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered. There is no classification system, and applicants should describe the goods of interest as the new law is still not operational.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Certified copy of priority document in case priority is to be claimed.

Trademark registration procedure in Mauritius:

The registration procedure lasts 60 months. The protection lasts 7 years from the filing date.

Trademark assignment deed in Mauritius has to contain a value. For goods, ad valorem tax of 8.8 percent is payable; for services, ad valorem tax of 4.4 percent is payable. Assignments may be done with or without Goodwill. Pending applications may be assigned. Unregistered marks may not be assigned.
