Trademark Registration in Malta: Requirements and Procedure

Trademark registration requirements in Malta:

- Power of attorney, notarized and legalized up to the Maltese Consulate or up to the British Consulate. Also attestation under an Apostille according to the Convention of the Hague is acceptable. You can download our Power of Attorney here.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Certified copy of priority document in case priority is to be claimed.

Trademark registration procedure in Malta:

The duration of registration of a trademark is 10 years, which start running from the date of registration.
The registration procedure lasts 8 months. After completion of examination the trademark will be published in the Malta Government Gazette. After the trademark is published, the opposition can be filed within 2 months. The protection lasts 10 years from the filing date.

Trademark renewal in Malta: The trademark may be renewed for further periods of ten years at the request of the proprietor, after the payment of the renewal fee within not more than six months before the date of expiry. The renewal takes effect from the expiry of the previous registration. If the registration of a trademark is not renewed, then the Comptroller removes the trademark from the register.
Trademark assignments in Malta: For the assignment we need the power of attorney legalized up to the Maltese Consulate or stamped and Appostilled.
