Trademark Registration in Lithuania: Requirements and Procedure
Trademark registration requirements in Lithuania:
- Power of attorney simply signed and stamped. (may be filed within 3 months from the filing date). You can download our Power of Attorney here.- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- An explanation or meaning and the origin of the trademark.
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- In case that priority is claimed, the certified copy of the priority document will be filed simultaneously with the application. The priority documents may be filed within three months from the filing date.
Trademark registration procedure in Lithuania:
After competition of the filing procedure and payment of the official registration fee, the trademark undergoes formal examination. After that the trademark is registered and published in the Official Bulletin. Within a period of 3 months after publication of the registered trademark (plus 2 months, extendable) any interested person may file an opposition against registration of the trademark. In absence of opposition or if the opposition has been rejected the registration certificate is issued. The grant decision is issued within 12-15 months from the filing date. The protection lasts 10 years from the filing date.Other trademark procedures in Lithuania:
Trademark renewal in Lithuania: The trademark renewal may be done within 12 months before expiry. For the trademark renewal we need the power of attorney simply signed and stamped. After trademark renewal the protection lasts 10 years.
Trademark changes in Lithuania: For changing the name or the address we need the power of attorney simply signed and stamped under the new name and the official document certifying change of name, such as an extract, from commercial register.
Trademark use in Lithuania: Non-use for 5 years following registration makes the registration vulnerable to cancellation.
