Trademark Registration in Libya: Requirements and Procedure

Trademark registration requirements in Libya:

- Power of attorney legalized up to the Libyan Consulate. 
- Legalized extract of the commercial register or certificate of incorporation.
- Certified copy of Home Registration Certificate, in case there is no home certificate, an alternative documents may be offered to the Registrar and he will decide case by case.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- In case that priority is claimed, the certified copy of the priority document will be filed simultaneously with the application.
Notes:
- Legalization of documents by the Libyan Consulate abroad must be done form the original country of the applicant and it is no longer accepted to be issued or authenticated from another country. As of 27 June 2004 the local classification of services is not valid. In class 33 of alcohol products a trademark cannot be registered.

Trademark registration procedure in Libya:

After acceptance, the trademark is published in the Libyan Official Gazette. The opposition period is within 3 month following publication. The registration procedure lasts 18 months. The protection lasts 10 years from the filing date.

Other trademark procedures in Libya:

Trademark renewal in Libya: The trademark renewal may be done 12 months before expiry. For the trademark renewal we need the power of attorney legalized up to the Libyan Consulate. After trademark renewal the protection lasts 10 years.
Trademark changes in Libya: For changing the name or the address we need the power of attorney duly legalized up to the Libyan Consulate, the certificate of change of name duly legalized up to the Libyan Consulate and a list of the trade marks concerned.
Trademark assignment and trademark license in Libya: For the trademark assignment we need the power of attorney notarized and legalized up to the Libyan Consulate, legalized extract from the commercial register or copy of the certificate of incorporation of the assignee and legalized deed of assignment.
Trademark use in Libya: Non-use for 5 years following registration makes the registration vulnerable to cancellation.
