Trademark Registration in Kuwait: Requirements and Procedure

Trademark registration requirements in Kuwait:

- Power of attorney legalized up to the Consulate of Kuwait.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known (Nice Classification, in which the classes are from 1 to 42).
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Certified copy of priority document in case priority is to be claimed.
- According to the new regulation issued on September 2005, the Registrar may ask from foreign legal person a copy of home registration certificate duly legalized up to the Kuwaiti Consulate at later stage.

Trademark registration procedure in Kuwait:

The registration procedure lasts 18 months. After the acceptance the trademark will be published in 3 consecutive issues in the Official Gazette. The opposition period is within 1 month after the publication. The protection lasts 10 years from the filing date.

Other trademark procedures in Kuwait:

Trademark renewal in Kuwait: The renewal may be done within the 12 months before expiry. For the renewal we need a power of attorney notarized and legalized up to the Consulate of Kuwait and the original registration certificate of endorsement. After renewal, the protection lasts 10 years.
Trademark changes in Kuwait: For changing the name or the address we need the power of attorney legalized up to the Consulate of Kuwait, the certificate of change of name legalized up to the Consulate of Kuwait and the registration certificate for endorsement.
Trademark assignments in Kuwait: For the assignment we need the legalized power of attorney signed by the assignee, the legalized deed of assignment signed by both parties and the registration certificate for endorsement.
Trademark use in Kuwait: Non-use for 5 years following registration makes the registration vulnerable to cancellation.
