Trademark Registration in Japan: Requirements and Procedure

Trademark registration requirements in Japan:

- No power of attorney is needed for Japan.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The details of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- In case that priority is claimed, the certified copy of the priority document will be filed simultaneously with the application.

Trademark registration procedure in Japan:

The mark is published before the registration in the Official Trademark Gazette. The opposition period is within 2 months following publication. The trademark is published after registration. The registration procedure lasts 18 - 24 months. The protection lasts 10 years from the filing date.

Other trademark procedures in Japan:

Trademark renewal in Japan: The trademark renewal may be done within 6 months before expiry. For the trademark renewal we need the power of attorney legalized. After the renewal the protection of the mark is for 10 years.
Trademark changes in Japan: For changing the name or the address we need the power of attorney simply signed under the new name, a list of trademarks concerned, a certified copy of certificate of change of name and a certificate of juridical person and a authorization of its capacity.
