Trademark Registration in Iraq: Requirements and Procedure

Trademark registration requirements in Iraq:

- Power of attorney duly legalized up to the Iraqi Consulate.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known. Although, Iraq follows multi-class application system, while each class is divided into sub-classes, a complete fee must be paid for each class and additional government fees must be paid for each additional sub-class. Applications in class 34, requires a sample of the packs.
- Details of the trademark owner (name, address, registration number)
- Transliteration of the mark in Arab language.
- Invoicing details (name, address, fiscal number, registration number).
- In case that priority is claimed, the certified copy of the priority document will be filed simultaneously with the application.

Trademark registration procedure in Iraq:

As of 5 October 2006, the Registrar is requesting the translation of the mark in order to be proceeding in examination. All documents can be submitted within 3 months from the date of filing. Legalization of documents by the Iraqi Consulate abroad now must be done from the original country of the applicant and it is no longer accepted to be issued or authenticated from another country, unless there is no Consulate in the original country. The opposition period is within 3 months following publication. The registration procedure lasts 18 months. The protection lasts 15 years from the filing date.

Other trademark procedures in Iraq:

Trademark renewal in Iraq: The trademark renewal may be done within 3 months before expiry with a grace period of 30 days. For the trademark renewal we need the power of attorney legalized. Failure to renew the mark in due time, it is possible to restore the mark within 1 year from the date of expiration. After trademark renewal the protection lasts 10 years, this new regulation started as of 2007.
Trademark changes in Iraq: For changing the name or the address we need the power of attorney including the eight-point declaration, legalized up to the Consulate of Iraq and legalized certificate of change of name issued by the Chamber of Commerce or any competent authority. All questions must be answered by the applicant. The legalization must be done on the overleaf of power.
Trademark assignment in Iraq: For the trademark assignment we need the power of attorney, including the eight-point declaration, legalized up to the Consulate of Iraq signed by the assignee. The legalization must be done on the overleaf of power. The deed of assignment signed by both the assignor and the assignee legalized up to the Iraqi Consulate.
Trademark use in Iraq: Any interested party, may apply to the court for a cancellation of the registration of any mark f it had not been used during the 2 years following the date of its registration, unless such none-use may be provided to be due to uncontrollable cause or lawful excuse.
