Trademark Registration in Indonesia: Requirements and Procedure in Indonesia

Trademark registration requirements in Indonesia:

- Power of attorney simply signed.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- In case that priority is claimed - the certified copy of the priority document will be filed simultaneously with the application.

Trademark registration procedure in Indonesia:

The registration procedure lasts 6 months from filing to registration. The protection lasts 10 years from the date of application filing date.

Other trademark procedures in Indonesia:

Trademark renewal in Indonesia: The trademark renewal may be done within 12 months before expiry. For the trademark renewal we need the power of attorney simply signed and the statement of the ownership and statement declaring that the marks is still in use. After trademark renewal the protection lasts 10 years. There is no grace period for the renewal allowed.
Trademark changes in Indonesia: For changing the name or the address we need the power of attorney simply signed, the certificate of change of name duly legalized up to the Indonesian Consulate and the original registration certificate for endorsement.
Trademark assignment in Indonesia: For the trademark assignment we need the power of attorney simply signed by the assignee, the legalized assignment document signed by both parties, the statement of intention to use by the assignee and the certificate of registration. The assignment and the license agreement must contain a price for such transfer. Trademark assignment in Indonesia may be done with or without Goodwill. Pending application may not be assigned and unregistered marks may not be assigned.
Trademark use in Indonesia: Non-use for 3 years after the last use makes the registration vulnerable to cancellation.
