Trademark Registration in India: Requirements and Procedure

Trademark registration requirements in India:

- Power of attorney simply signed. ( for foreign applicant POA is not required at the time of filing )
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- In case that priority is claimed - the certified copy of the priority document will be filed simultaneously with the application.
- Date of first use.

Trademark registration procedure in India:

After the acceptance of the application, the trademark will be published in the Trademark Journal. The opposition period is within 3 months following publication. The registration procedure lasts 2 years. The protection lasts 10 years from the filing date. India is not a member of Paris Convention, Madrid Agreement, Madrid Protocol or a member of Nice Agreement.

Trademark renewal in India: The trademark renewal may be done within 6 months before expiry. For the trademark renewal we need the power of attorney simply signed, a grace of period it’s allowed for the renewal within the deadline prescribed by expiry notification. After trademark renewal the protection lasts 10 years.
Trademark assignment in India: For the trademark assignment we need the power of attorney notarized simply signed and an certified copy of the trademark assignment deed. It is possible to assign unregistered marks. The marks can be assigned without the goodwill.
Trademark use in India: Non-use for 5 years and 1 month following registration makes the registration vulnerable to cancellation. It is possible to file an intent-to-use trademark in India.
