A trademark in this country may be registered through one of the 3 available systems of trademark registration:

1. National trademarks may be registered through the State Trademark Office.
2. Community trademarks may be registered through O.H.I.M. system.
3. International trademarks may be registered through W.I.P.O. system.


Trademark Registration in Estonia: Requirements and Procedure

Trademark registration requirements in Estonia:

- Power of attorney simply signed, indicating the full name and position of the person who signs the POA;
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Information related to the previously filed trademarks, in order to benefit of the priority date, as well as certified copy of the priority document. Subsequent filing of priority document in 3 months from filing is possible.

Trademark registration procedure in Estonia:

After completion of filing procedure the official notification of the receipt of the Application is issued within 3-4 months. Then the trademark undergoes substantive examination for about 15-18 months. On condition that the trademark meets the requirements of the law to be protected the grant decision is issued. After payment of the registration fee the certificate of registration is issued within 3-4 months. The procedure of the trademark registration takes from 12  to 15 months. Subsequent filing of power of Attorney in 2 months from filing. The opposition period is 2 months from publication in the Official Gazette. The protection lasts 10 years from the filing date.

Trademark renewal in Estonia: The renewal application must be done within 12 months before expiry. For the renewal we need the power of attorney simply signed
Trademark changes in Estonia: For changing the name or the address we need the official document certifying change of name.
Trademark assignments in Estonia: For the assignment we need the power of attorney signed by the assignor. Trademark assignment in Estonia may be done with or without goodwill. Pending application may be assigned, unregistered marks may not assigned.
Trademark use in Estonia: Non-use for 5 years following application filing date makes the trademark registration vulnerable to cancellation.
