A trademark in this country may be registered through one of the 3 available systems of trademark registration:

1. National trademarks may be registered through the State Trademark Office.
2. Community trademarks may be registered through O.H.I.M. system.
3. International trademarks may be registered through W.I.P.O. system.


Trademark Registration in Czech Republic: Requirements and Procedure

Trademark registration requirements in Czech Republic:

- Simply signed power of attorney.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Information related to the previously filed trademarks, in order to benefit of the priority date, if it is the case. In case that priority is claimed, the certified copy of the priority document will be filed simultaneously with the application.

Trademark registration procedure in Czech Republic: 

The opposition period is within 2 month following publication. The registration procedure lasts 18 months. The protection lasts 10 years from the filing date.

Other trademark procedures in the Czech Republic: 

Trademark renewal in Czech Republic: The trademark renewal may be filed within 12 months before expiry. For the trademark renewal we need the power of attorney signed and stamped and the original certificate of registration for endorsement. After trademark renewal the protection lasts 10 years.
Trademark changes in Czech Republic: For changing the name or the address we need the official document certifying change of name.
Trademark assignment and trademark license in Czech Republic: For the trademark assignment we need the power of attorney signed by the Assignee, the assignment document signed by both parties and the original registration certificate for endorsement. Trademark assignment and trademark license in Czech Republic may be done with or without Goodwill. Pending applications and unregistered mark may be assigned.
Trademark use in Czech Republic: When registered trademark has not been continuously used for 5 years for goods or services concerned, a cancellation action may by filed by a third party or it may be cancelled ex officio.
