A trademark in this country may be registered through one of the 2 available systems of trademark registration:

1. National trademarks may be registered through the State Trademark Office.
2. International trademarks may be registered through W.I.P.O. system.


Trademark Registration in Croatia: Requirements and Procedure

Trademark registration requirements in Croatia:

- Power of attorney simply signed and stamped.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Information related to the previously filed trademarks, in order to benefit of the priority date, if it is the case. In case that priority is claimed, the certified copy of the priority document will be filed simultaneously with the application.

Trademark registration procedure in Croatia:

The trademark is published in Trademark Journal Vestnik, before registration. The registration procedure lasts 12-18 months. The protection lasts 10 years from the filing date. The Examination is formal and substantive.

Other trademark procedures in Croatia:

Trademark renewal in Croatia: The trademark renewal may be done within 12 months before expiry. For the trademark renewal we need the power of attorney simply signed and stamped. After trademark renewal the protection lasts 10 years.
Trademark changes in Croatia: For changing the name or the address we need the power of attorney simply signed and stamped and the official document certifying change of name, such as extract from Register of companies.
Trademark assignment and trademark license in Croatia: For the trademark assignment we need the power of attorney simply signed and stamped by the assignee and the assignment deed notarized and legalized. Pending application may be assigned; registered marks may be assigned, but the assignment is effective only between parties.
Trademark use in Croatia: A registered mark may be cancelled at the request, if it has not been used for 5 years.
