Trademark Registration in Costa Rica: Requirements and Procedure

Trademark registration requirements in Costa Rica:

- Power of attorney legalized up to the Costa Rican Consulate.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Home registration certificate legalized up to the Consulate. In case not registered yet with home Patent Office and then a Statement of Adopted Trademark must be executed and legalized.

Trademark registration procedure in Costa Rica:

The opposition period is within 2 month following publication. The registration procedure lasts 12 months. The protection lasts 10 years from the filing date.

Other trademark procedures in Costa Rica:

Trademark renewal in Costa Rica: The trademark renewal may be done within 12 months before expiry. For the trademark renewal we need the power of attorney legalized up to the Costa Rican Consulate. After trademark renewal the protection lasts 10 years.
Trademark changes in Costa Rica: For changing the name or the address we need the power of attorney duly legalized up to the Costa Rican Consulate, the certificate of change of name duly legalized up to the Costa Rican Consulate and a list of the trade marks concerned.
Trademark assignment and trademark license in Costa Rica: For the trademark assignment we need the power of attorney notarized and legalized up to the Costa Rican Consul, a power of attorney signed by the Assignee, legalized by the Costa Rican Consul. Trademark assignment and trademark license in Costa Rica may be done with or without Goodwill. Pending Applications and unregistered marks may be assigned.
Trademark use in Costa Rica: A registered mark may be cancelled if it has not been used for 5 years following the date of registration.
