Trademark Registration in Colombia: Requirements and Procedure

Trademark registration requirements in Colombia:

- Power of attorney notarized and legalized up to the Colombian Consulate.
- Certified copy of the certificate of incorporation or any equivalent document notarized and legalized up to the Colombian Consulate.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Information related to the previously filed trademarks, in order to benefit of the priority date, if it is the case. In case that priority is claimed, the certified copy of the priority document duly notarized and legalized up to the Colombian Consulate will be filed simultaneously with the application.

Trademark registration procedure in Colombia:

Within 12 months after the approval in preliminary examination the trademark is published in the Chilean Official Gazette. The opposition period is within 30 days following publication. The registration procedure lasts 12 months. The protection lasts 10 years from the filing date.

Other trademark procedures in Colombia:

Trademark renewal in Colombia: The trademark renewal may be done before in 6 months before expiry. For the trademark renewal we need the power of attorney legalized by Apostil or Consulate and a Certificate of Good Standing of the company and then have it legalized. After trademark renewal the protection lasts 10 years.
Trademark changes in Colombia: For changing the name or the address we need the power of attorney notarized and duly legalized up to the Colombian Consulate, the extract from the commercial register evidencing the change of name duly legalized up to the Colombian Consulate and a list of the trade marks concerned.
Trademark assignment and trademark license in Colombia: For the trademark assignment we need the power of attorney legalized with Apostle or Consulate, the assignment Deed duly legalized by Apostle or Colombian Consulate and the Certificate of Good Standing of the company legalized.
Trademark use in Colombia: When a registered mark has not been continuously used in at least one of the Andean Community member countries (Bolivia, Colombia, Ecuador, Peru and Venezuela) for the good or services concerned for 3 years preceding the request for cancellation, a cancellation action may be filed by an interested person.
