A trademark in this country may be registered through one of the 2 available systems of trademark registration:

1. National trademarks may be registered through the State Trademark Office.
2. International trademarks may be registered through W.I.P.O. system.


Trademark Registration in China: Requirements and Procedure

Trademark registration requirements in China:

- Power of attorney, simply signed and stamped.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Information related to the previously filed by you trademarks, in order to benefit of the priority date, if it is the case. Certified copy of priority document in case priority is to be claimed.

Trademark registration procedure in China:

The registration procedure lasts 18 months. After the application is accepted and after the registration certificate is issued in the Trademark Gazette the trademark is published. After the trademark is published, the opposition can be filed. The protection lasts 10 years from the filing date.

Other trademark procedures in China: 

Trademark renewal in China: The renewal may be done within the 6 months before expiry. For the renewal we need a power of attorney simply signed, the representation of mark, the original Chinese Registration Certificate and a letter of instruction. After renewal, the protection lasts 10 years.
Trademark changes in China: For changing the name or the address we need a simply signed power of attorney under new name the original document certifying change of a letter of instruction including name and address of registrant both before and after change and the original Chinese certificate of registration
Trademark assignments in China: For the assignment we need the power of attorney simply signed, the assignment document singed by both parties, a copy of Chinese registration Certificate and an instruction letter including names and addresses of both parties. Trademark assignments in China must be done with Goodwill. Pending application may be assigned, unregistered mark may not be assigned.
Trademark use in China: Non-use for 3 years within the terms of validity makes the registration vulnerable to cancellation; it is possible to file for protection of a mark that is not being used.
