A trademark in this country may be registered through one of the 3 available systems of trademark registration:

1. National trademarks may be registered through the State Trademark Office.
2. Community trademarks may be registered through O.H.I.M. system.
3. International trademarks may be registered through W.I.P.O. system.


Trademark Registration in Bulgaria: Requirements and Procedure

Trademark registration requirements in Bulgaria:

- Power of attorney simply signed and stamped.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- If priority is claimed - information related to the previously filed trademarks and certified copy of priority document.

Trademark registration procedure in Bulgaria:

The trademark registration procedure lasts 18 months. The protection lasts 10 years from the filing date.

Other trademark procedures in Bulgaria:

Trademark renewal in Bulgaria: The renewal may be done within 12 months before expiry. For the renewal we need a simply signed power of attorney. The duration of the renewed trademark is of 10 years.
Trademark changes in Bulgaria: For changing the name or the address we need the power of attorney simply signed under the new data and an official document certifying change of name.
Trademark assignments in Bulgaria: For the assignment we need the power of attorney signed by assignee. An assignment deed, signed by both parties under hand or seal, notarized and legalized. Assignment may be done with or without Goodwill. Pending applications may not be assigned.
Trademark use in Bulgaria: When a registered mark has not been continuously used for the goods or services concerned for 5 years, a cancellation action may be filed by the interested person.
