Trademark Registration in Bolivia: Requirements and Procedure

Trademark registration requirements in Bolivia:

- The Power of Attorney should be certified by a Notary Public and legalized in your country before the Consulate of Bolivia.
- Certificate of incorporation duly legalized up to the Bolivian Consulate.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Information related to the previously filed by you trademarks, in order to benefit of the priority date, if it is the case. Certified copy of priority document in case priority is to be claimed.

Trademark registration procedure in Bolivia:

The opposition period is 45 days from publication in the Official Gazette. The protection lasts 10 years from the filing date.

Other trademark procedures in Bolivia:

Trademark renewal in Bolivia: The renewal may be done within the 6 months before expiry. For the renewal we need a power of attorney signed and legalized by Bolivian Consulate. The renewal protection lasts 10 years.
Trademark changes in Bolivia: For changing the name or the address we need the power of attorney signed and legalized (under new name).
Trademark assignments in Bolivia:
For the assignment we need the power of attorney signed by assignee, legalized by Bolivian Consulate. Please be informed that two percent tax on the stated in the contract amount is payable. The assignments may be done with or without goodwill. Pending applications may be assigned.
Trademark use in Bolivia: When a registered mark has not been continuously used in at least one of the Andean Community member countries (Bolivia, Colombia, Ecuador, Peru and Venezuela) for the goods or services for which the trademark was registered, a cancellation action may be filed by an interested person.
