Trademark Registration in Belize: Requirements and Procedure

Trademark registration requirements in Belize:

- Power of attorney notarized and legalized up to the Belize Consulate or by Apostille.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Information related to the previously filed by you trademarks, in order to benefit of the priority date, if it is the case. Certified copy of the priority document in case convention priority is to claimed. Certified copy of UK registration (if based on a UK registration).

Trademark registration procedure in Belize:

The registration procedure lasts 6 months. The opposition period is 60 days from publication in the Official Gazette. The protection lasts 10 years from the filing date.

Belize has established an independent trademark registration system effect from June 12, 2001. Current UK-based registrations will continue in force in Belize for their remaining term and pending UK-based applications will be processed as under the prior law, although they will be deemed registered under the new act. Any applicant for a pending UK registration filed in the UK by January 5, 2001 may apply no later than January 4, 2002 to register the same trade mark in Belize and thereby preserve the same application or priority date for Belize as accorded in the UK. At the same time, the common law of “passing off” and the doctrine of “honest concurrent user” have been retained.
