Trademark Registration in Argentina: Requirements and Procedure

Trademark registration requirements in Argentina:

- Power of attorney legalized up to the Argentinean Consulate or with apostil.
- Five prints of the mark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Information related to the previously filed by you trademarks, in order to benefit of the priority date, if it is the case.

Trademark registration procedure in Argentina:

The registration procedure lasts 2 years from filing to registration.. The opposition period is 30 days from publication in the Official Gazette. The protection lasts 10 years from the filing date.

Other trademark procedures in Argentina:

Trademark renewal in Argentina: The renewal application within 12 months before expiry. For the renewal we need the legalized power of attorney up to the Argentinean Consulate or stamped with apostil and the sworn declaration of use (in case of urgency or convenience it could be forwarded by fax). Delay is not legally admissible nor it is possible to obtain an additional time limit for its presentation.
Trademark changes in Argentina: For changing the name or the address we need the power of attorney duly legalized up to the Argentinean Consulate or with apostil. The document certifying the changing of the owners’ name with consular legalization and the registration certificate.
Trademark assignments in Argentina: For the assignment we need registration certificate, the assignment agreement executed by both parties with consular legalization of the assignors’ signature. If the assignment agreement does not include a power of attorney, then a separate document is required (legalized).
Trademark use in Argentina: The non-use for 5 years following registration and/or prior to the initiation of a cancellation action makes the registration vulnerable to cancellation; use of in any class at any time during the five years prior to expiration date is required for renewal purposes.
