Trademark Registration in Afganistan: Requirements and Procedure

Trademark registration requirements in Afganistan:

- Power of attorney legalized up to the Afghani Consulate.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Information related to the previsously filed by you trademarks, in order to benefit of the priority date, if it is the case.

Trademark registration procedure in Afganistan:

The registration procedure lasts 12 months. The opposition period is 15 days from publication in the Official Gazette. The protection lasts 10 years from the filing date.

Other trademark procedures in Afghanistan:

Trademark renewal in Afganistan: The renewal may be done within the last 12 months and a grace period of 3 months is given after the expiration date without penalty. For the renewal we need the legalized power of attorney and the last registration certificate.
Trademark changes in Afganistan: For changing the name or the address we need the power of attorney duly legalized up to the Afghani Consulate. Certificate of change of name duly legalized up to the Afghani consulate. Original trademark registration certificate for endorsement.
Trademark assignments and licence in Afganistan: For the assignment we need the power of attorney executed by the licensee legalized up to the Afghani Consulate. An assignment deed executed by both the assignor and the assignee and legalized up to the Afghani consulate. For the license we need the power of attorney executed by the license legalized up to the Afghani consulate and license agreement legalized up to the consulate of Afghani.
