National legislation
No statutory law on trademark protection exists, but registration (declaration of ownership of trademark) can be obtained under Section 18 (F) of the Registration Act. Remedies against passing-off can be applied for under Section 478 of the Penal Code, and against infringement under Section 54 of the Specific Relief Act and the Myanmar Merchandise Marks Act.
International legislation
Myanmar is a part of WIPO (World Intellectual Property Organization) treaties, as fallows:- WIPO Convention, since May 2001.
As a member of the World Trade Organization (WTO), Myanmar is Member and Signatory to TRIPS Agreement, since January 1995.
Membership of other bodies/treaties: Member of ASEAN since July 1997.
