Trademark rules S.I. No. 621 of 2007

Trade Marks Act, 1996. This text refers to "First Council Directive of December 21, 1988, to Approximate the Laws of the Member States Relating to Trade Marks (89/104/EEC)" available in the database as: "Marks, First Council Directive, 21/12/1988, No. 89/104"

Trade Mark Rules, 1963 (Amendment) Rules, 1992. "The Rules revised the level of fees set down in the original 1963 Rules".

Trade Marks Act, 1963 (Number 9 of 1963). "This Act makes new provisions in respect of trade marks and related matters, in substitution for the provisions of Part IV and (so far as it relates to trade marks) Part V of the Industrial and Commercial Property (Protection) Act 1927, and other enactments relating thereto, and to provide for other matters connected with the matters aforesaid".

Trade Marks Rules, 1963. "These Rules are made under Section 3 of the Trade Marks Act, 1963. They come into operation on such date as may be appointed for the commencement of the Act. They replace the rules (other than Rules 20, 21 and 22 of the Industrial Property Rules, 1927) relating to trade marks made under the Industrial and Commercial Property (Protection) Act, 1927".

Trade Marks Act, 1963 (Commencement) Order, 1964 (S.I. No. 34 of 1964). "The Order appoints 1 April 1964 as the date on which the Trade Marks Act 1963 (No. 9 of 1963) comes into operation. By virtue of Rule 3 of the Trade Marks Rules 1963 the date of commencement of those Rules is also 1 April 1964".

Patents, Designs and Trade Marks (International Arrangements) Order, 1959. This Order applies the provisions of Section 152 of the Industrial and Commercial Property (Protection) Act, 1927, as amended, (which provides for the granting of priority to a person who has applied for protection for any invention, design or trade mark in a foreign state) to the states listed in the Schedule. These are the states which, with Ireland, are bound by the International Convention for the protection of Industrial Property. "

Patents, Designs and Trade Marks (International Arrangements) (Amendment) Order, 1966. "The amendment extends the effect of the principal Order to Algeria, Gabon, Kenya, Malawi, Mauritania, Philippines, Senegal, South Africa, Southern Rhodesia, Trinidad and Tobago, Uganda, Union of Soviet Socialist Republics and Zambia".

Patents, Designs and Trade Marks (International Arrangements) (Amendment) Order (S.I. No. 32 of 1968). "This amendment extends the effect of the principal Order to Argentina, Cyprus, Dahomey, Malta, Togo, Puerto Rico, Virgin Islands (U.S.), Samoa (U.S.), Guam and Uruguay".

Patents, Designs and Trade Marks (International Arrangements) (Amendment) Order, 1976. "The amendment extends the effect of the principal order to Benin, Cameroon, Egypt, German Democratic Republic, Iraq, Jordan, Sri Lanka and Zaire".

Designs and Trade Marks (International Arrangements) (Amendment) Order, 1996. "The purpose of this Order is to extend the provision of Irish Designs and Trade Marks legislation to WTO countries".

Council Regulation (EC) No. 3295/94 of 22 December 1994 laying down measures to prohibit the release for free circulation, export, re-export or entry for a suspensive procedure of counterfeit and pirated goods.

Décret n° 37 du 30 janvier 1996 portant modification du Décret sur les brevets, dessins et modèles industriels et marques de fabrique ou de commerce. "Ce décret a pour but d'étendre aux pays Membres de l'OMC l'application de la législation irlandaise en matière de dessins et modèles industriels et de marques de fabrique ou de commerce".
 

International legislation

Ireland is membership of World Intellectual Property Organization (WIPO) treaties as part of:
- WIPO Convention since April 26, 1970;
- Paris Convention for the Protection of Industrial Property of March 20, 1883;
- Protocol Relating to the Madrid Agreement Concerning the International Registration of Marks, adopted at Madrid on June 27, 1989;
- Trademark Law Treaty adopted at Geneva on October 27, 1994;
- Nice Agreement Concerning the International Classification of Goods and Services for the Purposes of the Registration of Marks of June 15, 1957;

As member of World Trade Organization (WTO), Ireland is part of Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement) (1994) since 1 January 1995.

Ireland is also member of OHIM Regulations and International Treaties.
